{"id":117994,"date":"2018-06-02T13:45:12","date_gmt":"2018-06-02T12:45:12","guid":{"rendered":"https:\/\/www.realites.com.tn\/?p=117994"},"modified":"2018-06-02T13:22:16","modified_gmt":"2018-06-02T12:22:16","slug":"ghazi-chaouachi-appelle-a-la-poursuite-judiciaire-de-mabrouk-kourchid","status":"publish","type":"post","link":"https:\/\/realites.com.tn\/fr\/ghazi-chaouachi-appelle-a-la-poursuite-judiciaire-de-mabrouk-kourchid\/","title":{"rendered":"Ghazi Chaouachi appelle \u00e0 la poursuite judiciaire de Mabrouk Kourchid"},"content":{"rendered":"<p>Dans un post publi\u00e9, sur sa page facebook, dans la soir\u00e9e de vendredi \u00e0 samedi 2 juin 2018, le d\u00e9put\u00e9 du Courant d\u00e9mocratique \u00e0 l\u2019ARP, Ghazi Chaouachi a tir\u00e9 \u00e0 boulets rouges sur le ministre des Domaines de l&rsquo;Etat et des Affaires fonci\u00e8res, Mabrouk Kourchid, en appelant le minist\u00e8re public \u00e0 poursuivre en justice ce ministre pour \u00ab\u00a0<em>les crimes qu&rsquo;il a commis<\/em>\u00ab\u00a0.<br \/>\n\u00ab\u00a0Kourchid a assur\u00e9\u00a0lors d\u2019une conf\u00e9rence de presse, que le charg\u00e9 du contentieux de l\u2019Etat ne composera plus avec l\u2019IVD <em>\u00a0<\/em>en d&rsquo;autres termes, Mr le ministre a fait expr\u00e8s de porter atteinte \u00e0 la Constitution qui stipule l&rsquo;engagement de l&rsquo;Etat par le biais de toutes ses institutions \u00e0 respecter le processus de la justice transitionnelle. Cette d\u00e9cision refl\u00e8te aussi le d\u00e9sengagement de son d\u00e9partement de l&rsquo;accord conclu par l&rsquo;Instance et le minist\u00e8re charg\u00e9 des Relations avec les instances constitutionnelles, selon lequel l&rsquo;IVD continuera \u00e0 travailler jusqu&rsquo;\u00e0 la fin de sa mission. Le ministre s&rsquo;est mis dans la position du responsable, qui enfreint la constitution et la loi. Par ailleurs, il a d\u00e9lib\u00e9r\u00e9ment port\u00e9 atteinte \u00e0 l&rsquo;int\u00e9r\u00eat de l&rsquo;Etat suite \u00e0 son refus de r\u00e9cup\u00e9rer l&rsquo;argent d\u00e9tourn\u00e9 et son manque de r\u00e9activit\u00e9 et de responsabilit\u00e9 par rapport aux dossiers de r\u00e9conciliation financi\u00e8re alors que le budget de l&rsquo;Etat souffre d&rsquo;un grand manque de ressources. De ce fait, il faut poursuivre ce ministre en justice pour le crime selon l&rsquo;article 66 de la loi fondamentale de la justice transitionnelle qui inflige une peine de 6 mois de prison et une amende de 2000 dinars \u00e0 toute personne qui met des entraves dans le travail de l&rsquo;Instance, outre le crime d\u00e9fini par l&rsquo;article 96 du code p\u00e9nal qui inflige une peine de 10 ans et une amende \u00e9quivalente au montant du profit tir\u00e9 ou de l&rsquo;atteinte port\u00e9e par un fonctionnaire public contre l&rsquo;administration&#8230;c&rsquo;est un appel que je lance au minist\u00e8re public pour se mobiliser contre le ministre pr\u00e9cit\u00e9 et sa poursuite en justice pour tous ces crimes.
