Dans un communiqu\u00e9 rendu public dans la soir\u00e9e de ce lundi 16 septembre, l\u2019organisation \u201cI Watch\u201d a annonc\u00e9 avoir d\u00e9pos\u00e9 une plainte p\u00e9nale contre le pr\u00e9sident de l\u2019Instance sup\u00e9rieure ind\u00e9pendante pour les \u00e9lections (ISIE), Farouk Bouasker, ainsi que contre toute autre personne que l\u2019enqu\u00eate pourrait impliquer.<\/p>\n

La plainte fait suite au refus de l’ISIE d\u2019ex\u00e9cuter des d\u00e9cisions judiciaires d\u00e9finitives rendues par le tribunal administratif les 27, 29 et 30 ao\u00fbt 2024. Ces jugements ordonnaient l\u2019annulation des d\u00e9cisions de rejet de candidatures, permettant ainsi l\u2019inclusion de trois nouveaux candidats sur la liste finale des postulants aux \u00e9lections. Selon \u201cI Watch\u201d, l\u2019instance, repr\u00e9sent\u00e9e par son pr\u00e9sident, n\u2019a pas respect\u00e9 ces verdicts, malgr\u00e9 la r\u00e9ception officielle des d\u00e9cisions dans les d\u00e9lais pr\u00e9vus par la l\u00e9gislation \u00e9lectorale.<\/p>\n

L\u2019organisation anticorruption d\u00e9nonce ce qu\u2019elle qualifie de \u00ab\u00a0manquement grave \u00e0 l\u2019obligation d\u2019ex\u00e9cuter un jugement rev\u00eatu de la force ex\u00e9cutoire.\u00a0\u00bb En publiant la liste des candidats sans int\u00e9grer les personnes concern\u00e9es par les jugements, \u201cI Watch\u201d estime que l\u2019ISIE a commis une infraction relevant de l\u2019article 315 du Code p\u00e9nal tunisien. Cet article punit d’une peine de prison toute personne ne respectant pas les lois ou les d\u00e9cisions rendues par une autorit\u00e9 comp\u00e9tente.<\/p>\n

Par ailleurs, \u201cI Watch\u201d a \u00e9galement fait part d\u2019un incident survenu lors du d\u00e9p\u00f4t de sa plainte. Le bureau du substitut du procureur de la R\u00e9publique \u00e0 Tunis aurait refus\u00e9 de remettre \u00e0 l’organisation un r\u00e9c\u00e9piss\u00e9 de d\u00e9p\u00f4t, contrairement aux pratiques l\u00e9gales en vigueur. L\u2019association consid\u00e8re ce refus comme une entrave \u00e0 l\u2019acc\u00e8s \u00e0 la justice et une atteinte \u00e0 la s\u00e9curit\u00e9 judiciaire, rappelant qu\u2019aucune personne ou institution n\u2019est au-dessus des lois.<\/p>\n","protected":false},"excerpt":{"rendered":"
